THE NEW TODAY has obtained a copy of the medical report submitted by medical practitioner Dr. Kester Dragon who examined St. George’s North-east resident, Evan Smith after he was beaten almost a week ago by a white family in the Fort Jeudy area within the South St. George constituency.
The medical report is contained in a civil lawsuit that was served on the white family by a Court Bailiff acting on behalf of attorney-at-law, Derick Sylvester who is seeking financial compensation for Smith.
The lawsuit was filed against four members of the family – father Dolan Kavanagh, his female companion Sarah Hatton, and children Ted Kavanagh and Robart Kavanagh – who are being accused of beating Smith on the head, face and other parts of the body.
The civil lawsuit is separate from the criminal charge of causing Harm that was slapped by the police Sunday morning on the father and his lady friend.
The court action stemmed from an incident in which the local black man reportedly struck a dog by the family that had run across his vehicle on the public road in Fort Jeudy.
The lawsuit is seeking monetary damages in the form of compensation for Smith.
Speaking to THE NEW TODAY after the filing the court action, Sylvester said that he was not setting any figure on the compensation package but for the court to decide on a figure based on the evidence and circumstances of the incident.
The white family members are living in the nearby village of Egmont but reportedly ventured into Fort Jeudy where they are allegedly building a house.
Smith was in the area dropping off workers on a construction site where he is engaged in another project.
