Land dispute settle in Petite Martinique

Attorney-at-law Deloni Edwards appeared for Clement

High Court judge Justice Agnes Actie has given a ruling in another case of lands in dispute on the sister isle of Petite Martinique.

The battle was between Fisherman Hoyte Ollivierre and Martin Clement over a parcel of land amounting to 6, 375 Square Ft.

Ollivierre is challenging Clement’s claim to the land at Good Hope on the island of Petite Martinique and entered the property and demolished the fence erected along the boundary.

Clement approached the court seeking damages for trespass and for the damaged fence, as well as “special damages in the sum of $10,026.70, an injunction, interest, costs and other reliefs.”

Attorney-at-law Deloni Edwards appeared for Clement and Ruggles Ferguson K.C. for Ollivierre.

The judge ruled in favour of Clement and ordered the two sides to meet and arrive at a financial arrangement to settle the issue.

Following is the full ruling of Justice Actie on the case brought before her:-
