Female high court judge Justice Agnes Actie has ruled in favour of one of the island’s top architects who brought a case against a Grenada diplomat.
The case involved Erik Johnson of Atlantic Partnership Architects Inc and Ambassador Richard Nixon, a major player in Grenada’s controversial passport selling scheme known as Citizenship By Investment (CBI).
Johnson took court action for close to EC$150, 000.00 owed to him for professional services agreed to on an “oral contract” for an apartment building that Nixon was constructing in the well-to-do area of True Blue near to St George’s University.
Johnson claimed that Nixon only paid a fraction of the money and court action was instituted against him.
Attorney-at-law Hazel Hopkin appeared for Atlantic while her colleague Carah St. Paul was retained by Nixon.
Justice Actie handed down her ruling in the case on January 11.
In her ruling, Actie stated that the claimant (Atlantic) agreed orally to perform the requested services, and states that it was understood that the defendant would pay for the services upon the presentation of invoices for such services, rendered at a rate of 4% of the estimated build cost of $7,000,000.00.”
“The claimant further contends that the defendant, without its knowledge or consent, converted or caused to be converted for his own use and benefit, architectural designs, plans and drawings of the claimant for the construction of the defendant’s building,” she noted in the ruling.
